1. Introduction
These Terms of Service ("Terms") govern your use of the Ashmore Bespoke website and any services provided by Ashmore Bespoke ("we", "us", or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website or services.
2. Services
Ashmore Bespoke provides bespoke kitchen, bathroom, and interior design, supply, and installation services for homes in Mansfield and across Nottinghamshire. The specific scope, deliverables, materials, and timeline for each project will be agreed in writing before work begins.
3. Surveys, Quotations, and Pricing
- Any examples, descriptions, or project types shown on our website are for general guidance and do not form a binding offer.
- Quotations are based on the information available at the time of survey or enquiry and are valid for 30 days unless otherwise stated.
- All prices are in British Pounds (GBP) and are inclusive or exclusive of VAT only where stated in the quotation.
- Additional work requested beyond the agreed scope, or changes caused by site conditions that were not reasonably visible at survey stage, may incur additional charges. These will be discussed with you before extra work proceeds.
4. Payment Terms
- A deposit may be required before work begins, unless otherwise agreed in writing.
- Depending on project size, staged payments may apply for materials, fabrication, or installation milestones.
- Final payment is due in accordance with the quotation or invoice terms.
- Invoices are payable within 14 days of the invoice date unless a different term is stated.
- We reserve the right to delay ordering, fabrication, or installation where overdue amounts remain unpaid.
5. Project Process
Design and Approval
Where design drawings, material selections, or layout approvals are provided, you are responsible for reviewing them carefully before work proceeds. Once a design or order is approved, later changes may affect cost and timing.
Timelines
We will provide an estimated installation programme at the start of each project. Timelines depend on site access, timely decisions, supplier lead times, and conditions discovered during the work. Structural, plumbing, electrical, or substrate issues hidden before commencement may extend the programme.
Client Responsibilities
You agree to:
- Provide accurate information about the property and project brief
- Allow reasonable access to the property during agreed working hours
- Make timely decisions on layouts, finishes, and materials
- Ensure the working area is reasonably cleared where required
- Tell us about known site constraints, asbestos, access issues, or other relevant conditions
6. Materials and Bespoke Items
- Natural materials, paints, timber, stone, and similar finishes may vary in tone, grain, veining, and texture from samples or photography.
- Bespoke, made-to-order, or specially sourced items may not be returnable once ordered.
- Ownership of materials, goods, and fitted items remains with us until all sums due have been paid in full.
- We may substitute equivalent items where necessary because of supply issues, provided any substitution is reasonable and discussed with you.
7. Installation, Snagging, and Aftercare
- We will carry out our work with reasonable skill and care.
- On completion, you should inspect the work and notify us promptly of any snagging items or issues requiring attention.
- Minor snagging reasonably attributable to our work will be addressed within a reasonable time.
8. Warranties and Disclaimers
- We warrant that our work will be delivered to a professional standard and will be carried out substantially in line with the agreed quotation or project scope.
- We do not accept responsibility for delays or defects caused by underlying building issues, third-party products supplied by others, or conditions outside our reasonable control.
- Our website and services are provided "as is" without warranties of any kind, express or implied, except as required by law.
9. Limitation of Liability
To the maximum extent permitted by law, Ashmore Bespoke shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss not reasonably foreseeable, arising from your use of our services.
Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
10. Cancellation and Refunds
- If you wish to cancel a project after work has commenced, you must notify us in writing.
- Deposits are generally non-refundable once survey, design work, ordering, or fabrication has begun.
- Bespoke or specially ordered items may still be chargeable in full if cancellation happens after those items have been ordered.
- If we cancel a project for any reason, we will refund any payments made for work not yet completed, less any non-recoverable costs already incurred.
11. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the project. This obligation survives the termination of the project agreement.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
